Court dismisses ex-Pres Yameen's 'India Out' ban challenge
The petition was initially filed on grounds that the resolution, which prohibited the India Out campaign, violated constitutional rights.
Civil Court on Tuesday dismissed a petition filed by former President Abdulla Yameen challenging the resolution issued by then-President Ibrahim Mohamed Solih that banned the 'India Out' campaign during the previous administration.
The court dismissed the case after Yameen’s legal team failed to appear at the scheduled hearing.
According to the court's ruling, Yameen’s lawyer was summoned to attend the hearing at 1 pm Tuesday. However, the lawyer did not appear as required.
The court cited its procedural rules, which allow for the dismissal of a case if the plaintiff fails to appear at the specified date and time, without a valid excuse deemed acceptable by the court.
Judge Abdul Nasir Shafeeq presided over the case. The court noted that Yameen’s legal team did not provide a valid reason for their absence, leading to the dismissal of the case against the state.
The petition was initially filed on grounds that the resolution, which prohibited the India Out campaign, violated the constitutional right to freedom of expression. However, the resolution remains in effect and has not been repealed by President Mohamed Muizzu’s administration since the change in government.
