President sets example to ensure judiciary functions properly, PNC says
PNC reiterated that the judicial process should not be halted due to specific judges or cases.
Ruling People's National Congress (PNC) stated Wednesday that President Mohamed Muizzu is ensuring the constitution and laws are upheld and that the judiciary is functioning properly.
The statement comes as the Supreme Court hears a case regarding a constitutional amendment that would lead to MPs losing their seats if they change parties or leave their party. The matter has become contentious due to several recent developments:
-
The PNC passed a bill last week to remove two judges from the Supreme Court and reduce the bench to five. The president has not yet approved the bill.
-
Following the bill's passage, the government-controlled Judicial Service Commission (JSC) suspended three Supreme Court judges and launched an investigation into their conduct, affecting the progress of the seat reform case.
-
On Tuesday, Supreme Court Judge Husnu Suood resigned, making serious allegations against the president in his resignation letter.
The PNC issued a statement Thursday defending President Muizzu and the JSC while denying the allegations made by Suood and the opposition. The statement criticised Suood, claiming that his resignation demonstrated political activism rather than judicial impartiality.
The PNC alleged that Suood had engaged in political activities even before becoming a judge. The statement noted that instead of submitting his resignation to the JSC, as required by law, he had sent it to the President’s Office to make what the PNC described as baseless allegations.
The PNC further stated that Suood and other Supreme Court judges are being treated in accordance with the constitution and laws. The statement highlighted:
-
The 19th parliament, under the previous administration, amended the law to allow the temporary suspension of a judge under criminal investigation.
-
The amendment also outlined procedures for handling complaints against judges.
-
Independent commissions have a legal responsibility to address such matters, and President Muizzu has allowed them to operate without interference.
The PNC reiterated that the judicial process should not be halted due to specific judges or cases, stating that these processes must continue in line with constitutional and legal requirements.
The statement concluded by commending President Muizzu for upholding the constitution and ensuring the legal system functions properly.
