MVR 100K lost to state for AG’s attendance failure in court

On August 17, 2022, the then AG filed a case in the Civil Court seeking recovery of the money as it had not been paid.

The Civil Court has dismissed a case seeking MVR 100,000 in penalty in relation to a drug case, due to the Attorney General’s (AG) no show for the hearing.

Mahmood Abdullah, Hirudhugasdhoshuge/ Lh.Naifaru was convicted of trafficking in diamorphine and sentenced to life imprisonment along with a fine of MVR 100,000 by the Criminal Court on March 19, 2019. The judgement ordered the fine to be paid to MIRA within a month.

On August 17, 2022, the then AG filed a case in the Civil Court seeking recovery of the money as it had not been paid.

The Civil Court ruled on Sunday:

  • The AG's office was ordered to appear at the hearing on Thursday

  • The order was addressed to the AG, but the AG's office did not appear in court in response to the order

The civil court ruled that the AG's office had not appeared at the hearing without giving a valid reason.

The court has the power to dismiss the charge sheet if a responder fails to appear in court on the date and time specified in the court order without valid reason.
