Ali Hussain seeks order to halt actions on Supreme Court judges
The Supreme Court is scheduled to hear the case on Monday.
Lawyer Ali Hussain on Thursday filed a motion with the Supreme Court seeking an interim injunction to prevent any state body from taking action against Supreme Court judges while the court considers a petition challenging recent constitutional amendments.
The amendments in question mandate the loss of parliamentary seats for members who leave or are expelled from their elected political parties. A full bench of the Supreme Court is set to hear the case.
Ali Hussain has also requested an order restraining state authorities from:
-
Conducting disciplinary hearings against Supreme Court judges
-
Carrying out criminal investigations or initiating removal proceedings against judges
-
Taking any action that suggests such measures will be implemented
Ali Hussain argues that the case is a matter of public interest and that if judges face indirect threats of dismissal, it may affect the outcome of the case and compromise judicial independence.
The Supreme Court is scheduled to hear the case on Monday.
The opposition Maldivian Democratic Party (MDP), which is involved in the case, has alleged that the government is attempting to remove three Supreme Court judges and appoint individuals currently holding political positions.
