MDP, Fayyaz liable for remarks on president’s son: Family Court

The court found that Umair’s right to protection of reputation had been infringed based on comments made by Mariyam Zubair.

The Family Court on Sunday ruled that the Maldivian Democratic Party (MDP) and its chairman, Fayyaz Ismail, can be held responsible for remarks made about President Mohamed Muizzu’s eldest son, Umair Mohamed Muizzu.

The case was filed under the Child Rights Protection Act following statements made during an MDP demonstration, in which it was alleged that vape products were banned in Maldives because of Umair.

A separate civil suit on the same matter was previously heard in the Civil Court. In that case, the court found that Umair’s right to protection of reputation had been infringed based on comments made by Mariyam Zubair. However, the Civil Court ruled that Fayyaz and the MDP were not responsible.

In Sunday’s ruling, the Family Court decided:

  • Fayyaz Ismail, as party chairman, should be held responsible for the remarks made by Mariyam Zubair.

  • Mariyam Zubair and Ahmed Salim are responsible for their statements.

  • Fayyaz and the MDP may also face claims for damages.

The Family Court treated the matter separately from the civil proceedings and held that a damages suit could proceed, as the remarks were found to have violated the dignity of a child.
