Motion filed at Supreme Court against AG for non-compliance

Former MP Ali Hussain submitted the motion against Usham for not responding within the deadline.

A motion has been filed at the Supreme Court seeking action against Attorney General Ahmed Usham for failing to comply with a court order.

The Supreme Court had given the state 10 days to respond to a constitutional amendment that could result in the loss of a parliamentary seat.

Former MP Ali Hussain, who had also filed a constitutional case regarding the amendment, submitted the motion against Usham for not responding within the deadline.

In a post on 'X', lawyer Ali stated that the Supreme Court had informed him that the prosecution had not sought an extension of the deadline. He has requested the court to take action against the Attorney General under Article 124 of the Supreme Court rules, which defines failure to comply with court orders as a breach of court dignity.

The Judicial Service Commission (JSC) suspended three Supreme Court judges ahead of the scheduled hearing of the constitutional case. The commission, which includes Attorney General Usham and senior government officials, made the decision before the court was to hear an interim order regarding the seat loss procedure.

Four Supreme Court judges remain who are not under suspension. As per the Courts Act, a constitutional case requires a minimum bench of five judges to proceed.

The suspended judges are Azmiralda Zahir, Mahaz Ali Zahir, and Husnu Suood. Suood resigned from his position on Tuesday.
