High Court orders reinstatement of Shiyam to police
Shiyam was dismissed following a decision by the Police Disciplinary Board while serving as Commander of the North Police Division.
The High Court on Thursday ordered the reinstatement of Inspector of Police Ahmed Shiyam, who was dismissed from service in 2012.
Shiyam was dismissed following a decision by the Police Disciplinary Board while serving as Commander of the North Police Division. He had been accused of misuse of his position.
After his dismissal, Shiyam filed a case at the Civil Court. The court ruled that there were no grounds to order his reinstatement. He appealed the decision at the High Court.
In a judgment delivered by a three-judge bench, the High Court examined whether due process had been followed in the dismissal. The court stated that it must assess whether an investigation was conducted and whether evidence was presented to support the allegations.
The court found that the State did not demonstrate that the Disciplinary Board had conducted an investigation and did not submit evidence to support the claims against Shiyam.
The High Court ordered the Maldives Police Service to reinstate Shiyam. It also directed that he be paid salary and allowances from the date of dismissal until his return to service.
The bench comprised Judge Mohamed Shaneez Abdulla, Judge Huzaifa Mohamed and Judge Abdul Maaniu Hussain.
