A man who sprayed the wall of the Chinese embassy in March has been sentenced to 27 days in jail. However, since he has already spent 14 days in jail he will have to spend 12 more days in jail now.
According to the charge sheet filed by the state against Mohamed Anil, Minivan Asseyri/ Sh. Feydhoo, on March 26, he sprayed the opposition's India Out campaign slogan on the Chinese embassy wall with a blue spray bottle and vandalised the wall.
The prosecution charged him on June 6 with:
-
Vandalism
-
The basic sentence for the offence is one month and six days in jail
-
He pleaded guilty
While pleading guilty in court, Anil said he did it because a man named Mohammed told him to paint the wall. After pleading guilty, the case was taken up under expedited trial and on Thursday the case was decided that Anil was guilty beyond any reasonable doubt.
At the sentencing hearing, the prosecution requested:
-
27 days in jail as he had pled guilty
-
To deduct the time spent in custody
-
If Anil wishes, the jail sentence could be commuted to a fine
When Anil was given the opportunity to speak about the punishment, he also asked for the jail sentence to be commuted to a fine. He said he could pay the money.
However, the court ruled that his jail sentence could not be commuted to a fine. That is because Anil had not submitted the document required to confirm that the money can be paid.
Anil was sentenced to:
-
27 days in jail
-
He has already spent 14 days, 19 hours and one minute in custody and was sentenced to 12 more days in jail to complete his sentence
