The High Court on Monday issued an interim order to stop Sealife Global’s Managing Director Ahmed Moosa Mohamed from leaving the country.
The Criminal Court on 7th of this month ordered the release of his passport by 26th of this month as he has requested to go abroad for a spinal surgery. The prosecution filed an application in the High Court on the same day seeking an interim order prohibiting him from leaving.
In its interim order, the high court said that in order to prevent him from flying, the high court has sought an interim injunction to impound his passport or travel document, and if Ahmed Moosa's permission to fly has been challenged in the High Court and if he leaves while the matter is sub judice, the purpose of the appeal will be lost.
Therefore, Immigration has been ordered to ban him from leaving.
In 2014, Ahmed Moosa is accused of taking money from 280 people to build 3,000 flats on land in Hulhumale given by the then government.
He was arrested in 2021 on a red notice after fleeing to Sri Lanka. He has since been released from custody and has attempted to flee abroad twice, and his passport has been withheld so far, for fear of escape.
The Criminal Court banned him from leaving pending trial and seized his passport on June 16, 2021, on 42 counts of treason.
Ahmed Moosa, who is currently under house arrest, was released after his lawyer requested a review of the order on 29 last month.
The Criminal Court reviewed the order and issued the passport on grounds:
-
According to medical documents, Ahmed Moosa has been advised to undergo a spinal surgery
-
The surgery is considered to be a serious operation in itself and Ahmed Moosa's family also lives in Sri Lanka
-
Ahmed Moosa has cooperated with the court and the trial in the cases filed against him.
