Ali Hussain seeks SC stay on MPs losing seat under amendment

MP Abdul Sattar submitted a bill in his personal capacity, but the PNC leadership has instructed members to support it.

Former MP and lawyer Ali Hussain has petitioned the Supreme Court to stay the implementation of a constitutional amendment that would result in a member of parliament losing their seat if expelled from their party.

Ali Hussain has filed a petition seeking to quash the sections added to the constitution and has requested an interim order.

“Pending the Supreme Court deciding the case filed by me, I have moved for an interim order ordering no proceedings on the removal of any member of Parliament under the amendment in Article 73 of the constitution,” Ali Hussain stated on X.

His lawyer has also requested the Supreme Court to issue a stay order against a judge until the case is decided. The Supreme Court has yet to rule on the matter.

The case is being heard by a full bench of seven judges. The prosecution has raised a procedural objection, arguing that the Supreme Court does not have jurisdiction to hear the case.

Meanwhile, a bill has been introduced in parliament to reduce the number of Supreme Court benches from seven to five. Holhudhoo MP Abdul Sattar Mohammed submitted the bill in his personal capacity, but the PNC leadership has instructed members to support it.
