Chief magistrate's sacking proposed for contacting divorce petitioner

Adam was suspended on 25 May for two months, which expired on Sunday.

The Judicial Service Commission (JSC) on Sunday decided to file a case with the parliament to dismiss chief magistrate Ali Adam from the judgeship of the HDh. Kulhudhuffushi Magistrate Court for allegedly calling and texting a woman involved in a divorce case.

The Haa Dhaal Atolls chief judicial magistrate was also accused of two other such cases from before.

Adam was suspended on 25 May for two months, which expired on Sunday. 

JSC took Adam's statement on Friday over allegations that he called and texted a woman involved in a divorce case filed in the Kulhudhuffushi magistrate court. His suspension was renewed on Sunday based on his statement, the JSC said.

The commission said in a subsequent statement that it had decided to remove Ali Adam from the judgeship.

The JSC said the messages sent by Adam to the divorce petitioner showed that there was ill intention and an ulterior motive. It also proves that the judge took advantage of the woman’s vulnerable situation.

The JSC said:

  • Various statements have been made outside the court regarding the case

  • Adam offered friendship, and asked for personal information about the couple and other personal messages

  • Adam has asked the woman to delete the messages; this is evidenced by the screenshots available to the investigation, statements and Ali Adam's confession

Judges can only be removed by a vote in the parliament after the JSC decides so and submits it to the parliament.

The parliament will break from recess on August 16.
