Island Aviation Services (IAS) has filed an appeal in the High Court challenging an Employment Tribunal ruling that deemed the dismissal of Aishath Jennifer from her position as Deputy Managing Director (DMD) to be unlawful.

Jennifer, who was appointed as DMD during the previous administration, was removed from her position on December 28, 2023, following a board decision after the change in government. At the time, Jennifer was receiving a monthly salary of MVR 34,304, along with allowances amounting to MVR 21,867.

The Employment Tribunal issued its ruling on October 13, concluding that:

  • Jennifer’s termination violated the Employment Act.

  • IAS must reinstate Jennifer to her position as DMD.

  • IAS must pay Jennifer her salary and allowances for the period between her dismissal and the Tribunal's decision.

  • Jennifer is entitled to an additional one month's salary, amounting to MVR 56,717, as compensation.

According to the High Court registry, IAS appealed the decision on Tuesday of last week. The court has not yet determined whether to accept the appeal for review.

Jennifer had filed a complaint with the Employment Tribunal seeking several remedies, including:

  • Declaring the IAS board’s decision to dismiss her invalid.

  • Nullifying her dismissal notice and summons.

  • Recognising her as not having been lawfully dismissed.

  • Reinstating her as DMD within seven days of the tribunal's decision.

  • Requiring IAS to pay her the salary, allowances, and promotions she would have earned had she remained employed from the date of dismissal until the tribunal's decision, along with three months' salary as compensation for financial losses incurred.

  • Appointing legal representation for her tribunal case and covering all related costs.

  • Providing compensation and ensuring the payment is made in full within seven days.
