Ex-Fenaka MD charged for losses in millions

The court said that despite the allegations against them, their part was withdrawn as they did not have sufficient evidence against them.

Former Managing Director of Fenaka Corporation, Mohamed Nimal, has been booked for allegedly causing losses of more than MVR 1 million to Fenaka corporation for allegedly paying contractors without deducting MVR 2.54 million.

In November last year, the Anti Corruption Commission (ACC) had forwarded a request to the Prosecutor General's Office to prosecute Nimal in the case, which was found to have put the interests of suppliers first in connection with agreements signed with private companies to procure goods from Fenaka in 2014 and 2015. The commission had filed a chargesheet against four people, including Nimal, in the case.

According to the PG Office, the charge sheet was filed against Nimal and Minhaj Waheed, who was the then director of the finance division of Fenaka.  In December, they were charged with acting otherwise in a manner that was not beneficial to the state or the public.

The decision to file the charge sheet was taken as follows:

  • When they were in positions of Fenaka, in contracts between Plankton Investment Pvt. Ltd. and Pneumatic Pvt. Ltd. for the purchase of goods, and in the procurement policy of Fenaka Corporation Limited, if the goods were delivered after the expiry of the stipulated time period, the state would not be able to deduct the liquidated damages for the delayed days.  

  • This has resulted in loss of over MVR 1 million to Fenaka, the agency said.

In addition to Nimal and Minhaj, the ACC has filed a charge sheet against Ahmed Solih Nasir, who was then the Deputy Director of The Project Division of Fenakai, and Ahmed Azmeell, who was then the Deputy Director of the Finance and Accounts Division. 

The court said that despite the allegations against them, their part was withdrawn as they did not have sufficient evidence against them to prove the charges and did not appear to be in the interest of prosecution.

At the time of the incident, there were cases of alleged corruption in the purchase of diesel for Fenaka and the agency had sent the allegations to the PG seeking an investigation and prosecution. Nimal, who is now the president of K. Atoll, is also involved in those cases. However, it is not clear if the chargesheet was filed in these cases.
