The Judicial Service Commission (JSC) on Monday decided to accept the retirement of High Court Justice Mohamed Niyaz, the longest-serving judge on the court.
The JSC meeting was held to consider Justice Niyaz’s retirement request. It is understood that the commission decided to accept his retirement. The reason for his decision to retire has not been disclosed, although it is believed he sought retirement on health grounds.
Justice Niyaz submitted his retirement request while the JSC was conducting an inquiry into complaints regarding his conduct. He had earlier resigned as Vice-President of the Commission on 21 August. JSC Vice-President Yazmeed Mohamed was subsequently appointed to the position.
Justice Niyaz has also voted against the dismissal of two judges whose cases are connected to an ongoing Supreme Court matter concerning a constitutional amendment that could result in the loss of their seats.
The judges in question were suspended after Yazmeed Mohamed was appointed to the commission. Prior to that, the President was represented on the Commission by lawyer Mohamed Sameer.
